What criterion 10.16 says:

The teacher instructs and supervises students in ethical and legal uses of  technology. 

Translation and Discussion:

This criteria is designed to ensure that all teachers and students are aware of ethical and legal uses of technology.  This criteria simply states that all teachers must familiarize themselves and understand the laws regarding technology.  Teachers must teach their students about these laws and ensure that their students (as well as themselves) follow them.  

Teachers must read, understand and sign a school district's AUPTeachers must ensure that students using technology in the classroom read (or is read to them), understand and sign an AUP.  Teacher's must make parents aware of the district's Acceptable Use Policy. 

Teacher's must know about copyright law's and their school's fair use policy regarding all forms of technology.     

National Standards from ISTE regarding ethical and Legal use of technology state as follows:

"B. Personal and Professional Use of Technology.

 Candidates will apply tools for enhancing their own professional growth and productivity. They will use technology in communicating, collaborating, conducting research, and solving problems. In addition, they will plan and participate in activities that encourage lifelong learning and will promote equitable, ethical, and legal use of computer/technology resources."  Source:  ISTE  http://www.iste.org

Teachers who meet this criterion will:

  • Read, understand, and sign and follow the district's terms regarding acceptable use of technology.

  • Instruct the students on the district's terms regarding acceptable use of technology.  Have the students/parents sign an AUP.

  • Instruct students on fair and ethical use.

  • Instruct students on copyright laws.

  • Ensure that all students adhere to the guidelines set by the AUP.  This includes correctly using all school technology.

  • Ensure the students abide by fair use policies in projects, presentations and research papers.

  • Grade according to correct citation of sources when students submit projects, presentations, or research papers in class.

  • Model legal and ethical uses of technology when the teacher uses technology.  Abide by the laws, fair use policy, and AUP.

  • Ensure that all students have read, properly cited, and received author's permission (if necessary) before copying sources on the internet.

Possible teacher assessment tools or methods could include:

  • Teachers will show in lesson plans that the standard has been addressed.

  • Having a signed acceptable use policy for all students on file.  

  • The teacher have a signed acceptable use policy on file.  

  • Asking the students about copyright laws.  Looking at student work for signs of following copyright laws.

  • Student behavior.  For example - noting if the students are using the equipment in ways compliant to the school's AUP.

  • Taking action against students breaking the terms in the AUP.

  • Using the Teacher Technology Standard Continuum.

  • Test your copyright knowledge at the Benedict.com web site.

Education World is a web site for educators.  Nancy Willard has written a recent article about Internet copyright laws entitled Schools the Internet and Copyright Laws. 

Richlandclicks.org is a comprehensive web site that gives detailed information about fair use policies.  It is geared toward the educator and is broken down into student and teacher sections.

The Center for Intellectual Property defines a Fair Use Policy Policy.  This site contains reports, articles, dissertations, journal articles, and legal material about fair use policies.

This site gives useful information about fair use policies.  It gives a crash course in copyright laws and breaks the laws down into digital literature, and multimedia, etc. 

Bitlaw.  A comprehensive web site containing information about copyright laws, patents, trademarks and other internet legal issues.

Benedict.com.  This site deals with copyright laws and issues.  This site contains some very useful information to help teachers know and understand copyright laws. 

Kids Search Tools.  A boolean search engine for kids.  All the sites are geared toward kids and search only sites suitable for children.
